ఇదీ మన భారత్ - మేనకా గాంధీ

ప్రపంచ జనాభా ఇంచుమించు 800 కోట్లు. ప్రతి పది నిమిషాలకు 2500 మంది ఉద్యోగాలు కోల్పోతున్నారు. ఈ రోజు పుట్టిన బిడ్డలు పెరిగి పెద్దవుతారు; సందేహం లేదు. అయితే వారికి ఉద్యోగం లభించే రోజు ఎన్నటికీ రాదేమో?!

ఉద్యోగాలు లేకేం, ఉన్నాయి; అయితే వాటిని భర్తీ చేయడానికి సరైన అభ్యర్థులు లభ్యం కావడం లేదని చెప్పడానికి కాబోలు పెద్ద పెద్ద డిగ్రీలు ఉన్న వాళ్ళు అవసరమని అంటున్నారు. తొలుత బిఏ, ఆ తరువాత ఎమ్ఏ అవసరమన్నారు; పిదప బిఎడ్, అనంతరం పిహెచ్‌డి కావాలన్నారు. ఇప్పుడు ఎమ్‌బిఏను డిమాండ్ చేస్తున్నారు. డిగ్రీ స్థాయి విద్య సంగతి ఎలా ఉన్నా అది అసంగతమైనది. ఎందుకంటే మన కళాశాలలు అందిస్తోన్న మౌలిక విద్యలో గత యాభై ఏళ్ళుగా ఎటువంటి మార్పు లేదు కదా. కాకపోతే ఇన్ఫర్మేషన్ టెక్నాలజీ, ఆస్ట్రాలజీ కోర్సులను మాత్రం అదనంగా చేర్చారు. ఆర్ట్స్ విభాగంలో చరిత్ర, సాహిత్యం, భూగోళ, సాంఘిక, రాజనీతి శాస్త్రాలు మొదలైనవి; సైన్సెస్‌లో ఫిజిక్స్, కెమిస్ట్రీ, బయాలజీ, ఎందుకూ పనికిరాని జువాలజీ. ఈ విద్యాకోర్సులు చాలవరకు ఆ కోర్సులను బోధించే ఉపాధ్యాయులను మాత్రమే సృష్టిస్తున్నాయి.

అయితే భారతదేశపు అవసరాలు మారిపోయాయి. ఆర్థిక వ్యవస్థలో మౌలిక మార్పులు చోటు చేసుకున్నాయి. భూ కమతాల పరిమాణం అంతకంతకూ తగ్గిపోతోంది. హరిత విప్లవం సమకూర్చిన కలిమి కరిగిపోయింది; కల్మషం మిగిలి ఉత్పత్తి పడిపోతోంది. వేలాది జంతు, వృక్ష జాతులు అంతరించి మానవ జీవితం అవస్థల పాలవుతోంది. వాతావరణం వికృతమవుతోంది. పల్లెలు పచ్చని సీమలన్నది తాతల నాటి మాట. కొత్త సమస్యలను పరిష్కరించుకోవాలంటే విద్యా వ్యవస్థా మారాలి. ప్రపంచంలో అత్యధిక పాఠశాలలు ఉన్న దేశం మనదే. అయితే ఎంతమంది వాటి నుంచి లబ్ధి పొందుతున్నారు? పాఠశాల స్థాయిలో కాకపోయినా కళాశాలస్థాయిలో నైనా మనం కొత్త సబ్జెక్ట్‌లను బోధించవల్సిన అవసరమెంతైనా ఉంది.

మన ఆర్థిక వ్యవస్థలోను, జీవితాలలోను జంతువులు నిర్వహిస్తోన్న పాత్ర గురించి మరి చెప్పాలా? అయితే జంతువుల సంక్షేమానికి తోడ్పడే నిపుణులకు శిక్షణనిచ్చే సరైన విద్యావ్యవస్థలు మనకు ఉన్నాయా? కొన్ని వాస్తవాలు చెబుతాను. 31 పశువైద్య కళాశాలల్లో ప్రధాన అధ్యయనాంశం పశువుల వీర్యదానం. పాఠ్యాంశాల ఆధునికీకరణ చివరిసారి జరిగింది 1930లో! జంతు సంక్షేమానికి పురపాలక సంఘాలు అందిస్తున్న సేవలేమిటి? చెట్లను నరికివేయడంలోనేగానీ వృక్షాలను గుర్తించడంలోగానీ మన అటవీ శాఖ సిబ్బంది శిక్షణ పొందుతున్నారా? మన జాతీయ బడ్జెట్‌లో అటవీ శాఖ వాటా కేవలం 0.5 శాతం మాత్రమే!

మన దేశంలో వన్య ప్రాణుల వైద్యులు లేరు. జూ.నిపుణులు నాస్తి. పక్షులకు అవసరమైన వైద్యులు లేరు. కోతుల ఆరోగ్య బాగోగులు చూసేవారూ లేరు. జింకల, ఏనుగుల సంగతీ అంతే. పులులకూ డాక్టర్లు లేరు. అవసరమైన సబ్జెక్ట్స్‌లో ప్రత్యేక శిక్షణ పొందడానికై విదేశాలకు వెళ్ళేందుకు ఉపకార వేతనాలు అసలే లేవు. జంతువులకు బీమా సదుపాయం విషయమై మరి చెప్పనక్కర లేదు. రవాణాదారులుగా, ఇంధన ఆదాదారులుగా, ఎరువులు సమకూర్చేవిగా, చివరకు చెత్తా చెదారాన్ని దూరంగా పారవేసి పరిసరాలను పరిశుభ్రంగా ఉంచడంలో జంతువుల పాత్రను మనం కనీస మాత్రంగానైనా గుర్తిస్తున్నామా?

కబేళాల నిర్వహణలో మన నిపుణ నైపుణ్యాలేమిటి? జంతువుల ఆరోగ్యాన్ని దృష్టిలో ఉంచుకొని సరుకుల రవాణాకు ఉపయోగించే బళ్ళను రూపొందిస్తున్నామా? ఆ బళ్ళనులాగే దున్నపోతులలో 40 శాతం మెడ కేన్సర్లతో మూడేళ్ళలో చనిపోతున్నాయి. మాంసాహారం మూలంగా సోకే కేన్సర్లపై మనకు అవగాహన ఉందా? మాంసం దుకాణాలను ఏర్పాటు చేసే ప్రదేశాలు, లైసెన్స్‌లు జారీకి సంబంధించిన చట్టాలను పటిష్టంగా అమలుపరుస్తున్నామా? ఈ ప్రశ్నలకు అంతులేదు.

ఇలాంటి పరిస్థితులలో పొట్టి కొమ్ముల దుప్పి, కోతుల, చిరుతపులుల, శునకాల ఆరోగ్య సమస్యలను ఎలా పరిష్కరిస్తారు? రోగగ్రస్థ జంతువును చంపివేస్తే సరిపోతుందేమో?! ఇలా అసలు ఆ జంతువు దాదాపుగా అంతరించిపోయేదాకా చేస్తారు; ఆ తరువాత ఆ జంతువును రక్షించడానికి నానా పాట్లు (ఆర్థికంగా కూడా) పడతారు. చిరుత పులుల విషయంలో ఇదే కదా జరిగింది. సరే, పక్షులు వాలే చెట్లు కన్పించడం లేదేమిటి? గుర్రాలు గతంలో వలే ఎక్కువ కాలం ఎందుకు జీవించలేకపోతున్నాయి?

యూరోపియన్ దేశాలలోని పశువుల ఆహారమైన సోయాను సాగుచేయడానికి మధ్యప్రదేశ్‌లోని వ్యవసాయ భూములన్నిటినీ ఎందుకు వినియోగిస్తున్నారు? ఆహారంగా పనికిరాని మాంస భాగాలను పారవేస్తోంది సరస్సులు, నదులలో కాదూ? చైనా ప్రత్యామ్నాయ తోలు సాంకేతికతలను సృష్టించింది. మరి మన మాటేమిటి? గోబర్ గ్యాస్‌తో వంటచేసే విధానాలను మన మహిళలకు ఎలా నేర్పుతారు? సకల రంగాలలోను మన విధానాల రూపకల్పన బాధ్యతలలోకి ప్రవేశించి దేశపాలనను రైతుల, పేదల సంక్షేమానికి, ఆరోగ్య భద్రతకు అనుకూలంగా చేసేందుకు ఒక తరం సుశిక్షిత వృత్తి నిపుణుల అవసరం ఉన్నది. మనం జంతువులపై ఎంతగా ఆధారపడి ఉన్నామన్న విషయాన్ని గుర్తించినప్పుడే ఇది సాధ్యమవుతుంది.

ఈ వాస్తవాలను దృష్టిలో ఉంచుకొనే జంతు సంక్షేమం, సంబంధిత అంశాలపై ఒక విశ్వవిద్యాలయం ఏర్పాటుకు పూనుకున్నాను. 2002లో ఫరీదాబాద్‌లో దానిని నెలకొల్పాను. ఎనిమిది ఎకరాల వైశాల్యంలో భవన నిర్మాణం కూడా జరిగింది. బోధన, బోధనేతర సిబ్బంది నియామకాలకు ప్రభుత్వ అనుమతి లభించింది. తొలుత ఆక్స్‌ఫర్డ్, కేంబ్రిడ్జి, యేల్ మొదలైన విశ్వవిద్యాలయాల ఆచార్యులు కొంతమంది ఫరీదాబాద్ వర్సిటీకి రావడానికి అంగీకరించారు. యుఎన్ఇపి నుంచి గ్రంథాలయానికి నిధులు మంజూరయ్యాయి.

మొత్తం 43 కోర్సుల బోధనకు ఏర్పాట్లు జరిగాయి. డీమ్డ్ యూనివర్సిటీగా గుర్తింపు నివ్వాలనే ప్రతిపాదనను ప్రభుత్వం చురుగ్గా పరిశీలించింది. జంతు సంక్షేమానికి రూపొందించిన కోర్సులలో కొన్ని-యానిమల్ న్యూట్రిషన్, కమర్షియల్ ఫ్యాక్టరీ, జూ అండ్ లేబొరేటరీ మేనేజ్‌మెంట్, ఆర్గానిక్ ఫార్మింగ్, బర్డ్ కేర్, వెటెరినరీ ఫార్మసీ, వాటర్ అండ్ ఫారెస్ట్ మేనేజ్ మెంట్, కబేళా నిర్వహణ మొదలైనవి. ఇక బయాలజీ, ఫిజియాలజీ, అనాటమీ మొదలైనవి ఎలాగూ తప్పనిసరి కదా.

ఈ సబ్జెక్ట్స్‌లో నాలుగేళ్ళ బిఏ కోర్సుతో పాటు, ఒకటి రెండు సంవత్సరాల కోర్సులు కూడా ఉంటాయి. పోలీసు, మునిసిపల్ ఉద్యోగులకు స్వల్పకాలిక కోర్సులు రూపొందించాము. ఆ విశ్వవిద్యాలయానికి 'నేషనల్ ఇన్‌స్టిట్యూట్ ఫర్ యానిమల్ వేల్ఫేర్' (ఎన్ఐఎడబ్ల్యు) అని పేరు పెట్టాము. అది సక్రమంగా సాగివుంటే జంతువులకు సంబంధించిన మన ఆలోచనలు సమూలంగా మారిపోయివుండేవి. ఒకప్పుడు మన దేశంలోని న్యాయశాస్త్ర కళాశాలల పరిస్థితి చాలాఘోరంగా ఉండేది. లా కోర్సులను అందరూ చాలా తేలిగ్గా చూసేవారు. అయితే బెంగుళూర్ లా స్కూల్ నేర్పాటు చేసిన తరువాత ఆ పరిస్థితి మారిపోయింది.

దేశ వ్యాప్తంగా ప్రతి లా కళాశాలకు, ప్రతి న్యాయశాస్త్ర విభాగానికి బెంగుళూరు లా స్కూల్ ఒక కొత్త స్ఫూర్తి అయింది. న్యాయశాస్త్ర అధ్యయనం, బోధనలో మౌలిక మార్పులు సంభవించాయి. ఎన్ ఐ ఎ డబ్ల్యు పట్టభద్రులకు ఉద్యోగాలు దొరికేవేనా? ఎందుకు దొరకవు? సిటీ మేనేజ్‌మెంట్, వైల్డ్ లైఫ్, లేబొరేటరీస్, ఆస్పత్రులు, షెల్టర్స్, ఎన్ జి ఓలు, కబేళాలు, జంతు ప్రదర్శన శాలలు, పశు వైద్య కేంద్రాలు, పురపాలకసంఘాలు, పరిశ్రమలు....... ఇంకా ప్రపంచవ్యాప్తంగా వేలాది కన్సల్టెన్సీలు ఉన్నాయి.

ప్రపంచంలో 62 విశ్వవిద్యాలయాలు జంతుసంక్షేమంపై కోర్సులు నిర్వహిస్తున్నాయి. ప్రతి విశ్వవిద్యాలయాన్నీ సంప్రదించాము. మాకు సహాయమందించడానికి అందరూ అంగీకరించారు. సంకల్పించినదంతా ఆచరణలోకి వచ్చివుంటే ప్రతి ఒక్కరూ జంతు సంక్షేమంపై విశేష శ్రద్ధ చూపేవారు. డిగ్రీ కూడా పొందేవారు. సుశిక్షితులైన వారి అవసరం ఉన్న ప్రతిరంగంలోనూ వేలాది ఉద్యోగాలు ఉన్నాయి.

ఇంతలో అంటే 2002లో నన్ను కేంద్ర మంత్రి మండలి నుంచి తొలగించారు. ఎన్ఐఎ డబ్ల్యును పర్యావరణ మంత్రిత్వ శాఖకు అప్పగించారు. ఎన్డీఏ ప్రభుత్వం దాన్ని మరచిపోయింది. అమిటీ తదితర ప్రైవేట్ విశ్వవిద్యాలయాలు దాన్ని నిర్వహించడానికి ముందుకు వచ్చాయి. అయితే పర్యావరణ మంత్రిత్వ శాఖ సుముఖత చూపలేదు. జంతువుల పట్ల 'కరుణ' చూపడంలో ప్రభుత్వోద్యోగులకు రెండురోజుల కోర్సులను ప్రవేశపెట్టింది. ఆ తరువాత జంతువులకు సంబంధించిన చట్టాలపై ఉక్కు, బొగ్గు మంత్రిత్వ శాఖలకు చెందిన క్రింది స్థాయి ఉద్యోగులకు మూడు రోజుల కోర్సులు నిర్వహించారు.

గత ఆరేళ్ళలో వారు ఇలా అర్థంపర్థం లేని 40 కార్యక్రమాలను నిర్వహించారు. ఎన్ఐఎడబ్ల్యు కు సరైన నిర్వహణ లేదు. సిబ్బంది ఏలరు. ఈ కోర్సులను ఆయా మంత్రిత్వ శాఖల జాయింట్ సెక్రటరీలు బోధిస్తున్నారు. ట్రిపిల్ థియరిమ్స్ గురించి నాకు ఎంత తెలుసో ఆ ఐఏఎస్ బాబులకు జంతు సంక్షేమం, చట్టాల గురించి అంతే తెలుసు మరి. ఈ సంస్థకు కేటాయించిన నిధులను జనరల్ బడ్జెట్‌కి మళ్ళించారు. ఎన్ఐఎడబ్యుని భారత ప్రభుత్వ ఆధ్వర్యంలోని జంతుసంక్షేమ సంస్థకు అప్పగించాలని నేను చేసిన ప్రతి విజ్ఞప్తీ బధిరుని ముందు శంఖారావమే అయిపోయింది.

మన ప్రభుత్వాధికారులలో కొత్త భావాల పట్ల వ్యతిరేకత, బద్ధకం, స్వార్థపరత్వం మూలంగా దేశ శ్రేయస్సుకు తోడ్పడే ఇంకెన్నో అద్భుత అవకాశాలు వ్యర్ధమైపోతున్నాయి. ఎన్ఐఎడబ్ల్యు గత ఆరేళ్ళుగా సక్రమంగా సాగివుంటే ఇప్పటికి ఎంతో మంది జంతు సంక్షేమ నిపుణులు తయారయివుండేవారు; పులులను, సీతాకోకచిలుకలను, మిగతా భారతదేశాన్ని రక్షించగలిగి వుండేవారు.

Namo Narendra Modi - Despise him, but you can not ignore him

Narendra Modi is one of the controversial and polarizing figures in the present political discourse. The rise of this small town boy from Vadnagar in Mehsana District had been remarkable in the Indian Polity. A strong organizational man from RSS, Modi was the National Secretary of BJP in various states until he took over the reins of Gujrat in October 2001 from Keshu Bhai Patel.

Development:

The state of Gujrat had witnessed an unprecedented growth and development since 2001 under the guidance of Namo as he is affectionately called by his supporters. Narendra Modi had been a CM who is working for the 6 crore Gujraties. When he assumed the office of CM in Gujrat, the state was ranked 25th in the female literacy rate, since then the state had been able to achieve a 100 % literacy for the Girl child across the communities.

As a Chief Minister, Narendra Modi had started various plans. This includes Panchamrut Yojana a five-pronged strategy for an integrated development of the state, Sujalam Sufalam, a scheme to create a grid of water resources in Gujarat in an innovative step towards water conservation and its appropriate utilization. He has come up with the following innovative plans for entire Gujrat and which can be emulated and effectively implemented across India.

  • Krishi Mahotsav – agricultural research labs for the land
  • Chiranjeevi Yojana – To reduce infant mortality rate
  • Matru Vandana – Providing preventive and curative services under the Reproductive and Child Health Programme
  • Beti Bachao – Campaign against female infanticide to improve sex ratio
  • Jyotigram Yojana – Provide electricity to every village
  • Karmayogi Abhiyan – To educate and train government employees
  • Kanya Kelavani Yojana – To encourage female literacy and education
  • Balbhog Yojana – Midday meal scheme for students to encourage school attendance from poor backgrounds.

Controversy:

Although widely recognized as a man of integrity, he has his share of controversy for his role and inability to contain the post Godhera riots. He has further been criticized for his action and reaction comments just after the Godhera carnage. The then Prime minister of India, Atal Bihari Vajpayi, advised him to follow the Raj Dharma, while the rehabilitation and relief work was going on after the post Godhera Mayhem.

Godhera Train Burning

In Godhera 58 Hindu Men/ Women and Children were burned alive by a Muslim mob in the bogey number S6 of the Sabarmati express, along with the shouts of Allah-hu-akbar and Islam is in danger, from the loudspeaker of a local mosque. India today published the complete graphic details of the Godhera Carnage and its planning. This was particularly a ghastly and unique incident in the history of modern India. It was unique in the sense that it was a direct attack on the Hindu community, unlike any other terrorist incident where the attack is directed against the Government. Parts of Gujrat witnessed unprecedented rioting during the Post Godhera carnage. There was two day delay in deploying the military from the center as the Indian army was in eye to eye confrontation on the western Borders with Pakistan, just after the 2001 Parliamentary attack. Around 1200 people died 800 Muslims and 400 Hindu’s in post-Godhera carnage. After the riots the state had witnessed relative peace, despite the Ahemdabad serial bombing by the terrorists in 2008.

Apart from Godhera, the two major incidents, where the Hindu community was directly targeted, in the recent History in India were, first the Direct action day in 1947, where 5000 Hindu’s were butchered on the streets of Kolkata and second was the targeted killing of Kashmiri Hindu’s, which started with the killing of eminent Kashmiri Pt. Tika Lal Taploo in early 1990’s, and led to the mass exodus of Hindu’s from the Kashmir valley. In Kolkata there was a political intervention by none other than Mahatma Gandhi to break the cycle of counter violence. In valley Hindu’s are in Minority and the targeted killing led to their mass exodus, and still after 20 years they are languishing in the transit camps, without much facilities.

The entire political class across India failed to gauge the gravity of the situation arising out of the Godhera train burning. The liberals tried to dismiss it as a mere law and order problem, a criminal act, their lack of sensitivity and ingenuity in dealing with such a complex issue further led to the deterioration of the situation. What shall have been a political response immediately on the aftermath of Godhera, from all the parties concerned, including the Muslim intelligentsia? The irony is that there was none. It was just a deafening silence, a ticking time bomb. What followed next were riots, loot and arson by the mobs. Namo was new to the job of CM and his inexperience with dealing with such a situation definitely didn’t helped.

Misinformation Campaign

There is a concerted misinformation campaign against Narendra Modi and his government. The shrill vitriolic does not stop at that, even the number of Muslim riot victims is fudged. The fudging of Muslim riot victims varies between 2000, 3000 and 5000. The Hindu riot victims are not even mentioned in the political discourse by the vested interests.

Sadbhavna Mission:

The view to see communal riots as just another Law and order problem is not right. Although the courts can arbiter after the riots, but they cannot contain and control the riots. A wider political approach and discourse is needed to contain this menace. Riots do not bring out the best of the Human beings. The tendency among the vested interests to see these riots as isolated incidents does not help either. Goodwill/ sadbhavna has to be created among the communities. Namo has taken the right step with his fast for Sadbhavna. May there be peace and tranquility in Bharat.

Indian Muslims will oppose Kashmir secession : Gulam Ali

Pune, November 15 : “Kashmir is an integral part of India & no power in the world will succeed in tearing it apart from India”, said Gulam Ali ‘Engineer’, a prominent social worker from Jammu. Speaking here in a seminar on Kashmir, he also declared that the Indian Muslims will oppose any attempt to isolate Kashmir from India.

Muslim Rashtriya Manch is carrying out an awareness campaign in the nation about the Kashmir issue. Maharashtra state branch had organized a seminar – ‘Ham Hindusthani, Kashmir Hindusthan ka’ (हम हिंदुस्थानी, कश्मीर हिंदुस्थान का’) in Pune as part of the campaign. Shri. Gulam Ali was speaking as the chief guest at the seminar held at the Pune Patrakar Bhavan’s Cummins hall. Pune University ex-VC Dr.S.N. Navalgundkar presided the seminar. Rashtriya Muslim Manch office berarers Latif Magdum, Irfan Ali Pirjade & Virag Pachpor were also present.

Shri. Gulam Ali, who himself hails from Jammu, accused that “the Kashmiri muslims are being exploited & desiccated in the name of Islam for years together. Muslims should stand now as a force for the India. We all are Indian first, even if our language & religions are different.” Shri. Gulam Ali called upon the muslims to ignore the politicians who are hell-bent upon deviding the society. He also called upon the society to stand united against divisive forces to make India stronger.

Delivering the presidential address, Dr.Navlgundkar said that, “Jammu & Kashmir is the very crucial state from security point of view for India. Today China is also bullying India from all corners. We should trade cautiously & observe caution. It’s the call of the time to strengthen the emotion of National Integration among the Indian society.”

Shri. Virag Pachpore, who is the organizing secretary of the Rashtriya Muslim Manch for Gujrat & Maharashtra, talked about the Kashmir problem, while introducing the theme of the seminar. In his foreword to the seminar, Shri.Latif Magdum, who is also a office bearer of Azam Campus - a prominent educational institution in the camp area of Pune, introduced the activities of the Muslim Rashtriya Manch.

Muslim Satyashodhak Samaj’s Sayyadbhai also spoke about the Kashmir issue & it’s effects. He assured the audience that the Muslim Satyashodhak Samaj will continue to support any activities to secure Kashmir’s integrity with India.

Prof.Rahin Shaikh compered while Irfan Ali Pirjade proposed a vote of thanks.

హైదరాబాద్, నవంబర్ 14: కేంద్ర ప్రభుత్వం ప్రతిపాదించిన మత బిల్లు సమాజాన్ని ముక్కలు చేసేందుకు ఉద్దేశించినట్టు కనిపిస్తోందని కేంద్ర మాజీ మంత్రి ఆరిఫ్ మహ్మద్ ఖాన్ వ్యాఖ్యానించారు. ఆంగ్లేయుల పాలనలోనూ విభజన యత్నాలు జరిగాయని ఇప్పుడు తాజాగా కేంద్రం కూడా అదే పనిచేస్తోందని ఆయన ఆరోపించారు. ‘సోషల్ కాజ్’, ప్రజ్ఞ్భారతి సంస్థలు సంయుక్తంగా మత హింస నిరోధక బిల్లుపై సోమవారం సాయంత్రం కేశవ్ మెమోరియల్ అకడమిక్ కాంప్లెక్స్‌లో నిర్వహించిన సెమినార్‌లో ఖాన్ మాట్లాడారు.

చట్టాలను సవరించుకోవచ్చునని కానీ మానసిక విభేదాలు తలెత్తితే సమసిపోవని, దేశం అంతా సమైక్యం అనే భావనకు భంగం కలిగించేలా ఈ బిల్లు ఉందని ఆయన అన్నారు. వ్యక్తులలో మైనార్టీ, మెజారిటీ అనే నిర్వచనం సరికాదని ఒక రాష్ట్రంలో మైనారిటీగా ఉన్న వారు మరోచోట మెజార్టీగా ఉండొచ్చు, శాశ్వతంగా ఎవరూ మైనారిటీ గానో, మెజారిటీగానో ఉండరు కదా అని అన్నారు. ఏ బిల్లుపైనైనా ముందు చర్చ జరిగితే తర్వాత రచ్చ జరగదని, ముందు చర్చ జరగకపోతేనే వివాదాలు తలెత్తుతున్నాయని చెప్పారు.

మత హింస నిరోధక బిల్లు అమలులోకి వస్తే హిందువులు మిగలరని ఆంధ్రభూమి సంపాదకుడు ఎంవిఆర్ శాస్ర్తీ పేర్కొన్నారు. సామాన్య హిందువుల మనుగడ ప్రశ్నార్ధకమవుతుందని, తాము ఈ మతంలో ఎందుకున్నామా అనే ఆలోచనలో పడతారని తెలిపారు. మతాంతరీకరణ ఉద్ధృతంగా జరుగుతున్న దశలో ఇలాంటి చట్టం వస్తే దాని బారిన పడకుండా మత మార్పిడి కోసం ఆలోచించే ప్రమాదం ఉందని అన్నారు. ఇతర మతస్థులను కాపాడేందుకు మత హింస బిల్లు వస్తున్న తరుణంలోనైనా హిందూ మత పెద్దలపై జరుగుతున్న దాడులు మత హింస కిందకు వస్తాయో, రావో ఆలోచించుకోవాలని సూచించారు. ఈ బిల్లుపై ఆలోచించకుండా మనకెందుకు అనుకుంటే మనం కూడా మిగలమని అన్నారు. ఒకపుడు జమ్మూకాశ్మీర్‌లో రెండు రాజ్యాంగాలు ఉన్నందుకే శ్యాం ప్రసాద్ ముఖర్జీ ఆవేదన చెందారని, కానీ ప్రస్తుతం దేశవ్యాప్తంగా రెండు రాజ్యాంగాలను తెచ్చిపెట్టబోతున్నారని, కనీసం రెండు రాజ్యాంగ న్యాయాలు రాబోతున్నాయని అన్నారు. హిందువులు వౌనంగా ఉన్నా సమస్యలు తప్పబోవని పేర్కొన్నారు.

మత బిల్లు జిన్నావాదానే్న తెరమీదకు తెస్తోందని ఆర్‌ఎస్‌ఎస్ కేంద్ర కమిటీ సభ్యుడు రాం మాధవ్ అన్నారు. జిన్నా వాదన భూమిక ఆధారంగానే ఈ బిల్లు రూపొందించినట్టు కనిపిస్తోందని, సహజన్యాయానికి తావులేకుండా వివక్ష పూరితంగా ఈ బిల్లు ఉందని ఆరోపించారు. ఈ బిల్లు అమలులోకి వస్తే మతాల మధ్య సుహృద్భావం అసాధ్యమవుతుందని, ఈ బిల్లు చట్టం కాకుండా ఆపాల్సిన బాధ్యత అందరిపై ఉందని అంటూ రాం మాధవ్ అనేక అంశాలను ప్రస్తావించారు. జాతీయ సలహా మండలి ఈ బిల్లు ముసాయిదా తయారుచేయడానికి ఉన్న స్థాయిత్వం ఏమిటో అర్ధం కావడం లేదని అన్నారు. ఐక్యతకు మహాత్మాగాంధీ అన్ని విధాలా కృషి చేసినా, జిన్నా మాత్రం దేశ విభజనకే మొగ్గుచూపారని, బిల్లును వ్యతిరేకించే వారందిరినీ మతతత్వ వాదులుగా చూడటం దారుణమని అన్నారు. ఈ బిల్లు వచ్చాక ఉన్న అధికారాలు కాస్తా కేంద్ర ప్రభుత్వానికి ధారాదత్తం అవుతాయని పేర్కొన్నారు. దేశ ఐకమత్యాన్ని ఈ బిల్లు ముక్కలు చేస్తుందని, ఇలాంటి బిల్లునే 2007లో హోస్ని ముబారక్ ఇరాక్‌లో తేవడం వల్ల మూడేళ్లు తిరగకుండా అక్కడ ఏం జరిగిందో అందరికీ తెలుసునని చెప్పారు.

పోలీసు వ్యవస్థకు స్వయం ప్రతిపత్తి

మత బిల్లు సమాజం మరింత విడిపోయేందుకు తోడ్పడేలా ఉందని మాజీ డిజిపి సి ఆంజనేయరెడ్డి అన్నారు. బాధితులకు పరిహారం చెల్లించే అంశం తప్ప ఈ బిల్లులో పనికొచ్చే క్లాజులు ఏవీ లేవని ఆయన వ్యాఖ్యానించారు. పోలీసు యంత్రాంగానికి అధికారాలు ఉన్నాయని, ఇపుడు కొత్తగా అధికారాలు ఇవ్వాల్సిన అవసరం లేదని, ఉన్న చట్టాలను పటిష్టంగా అమలుచేస్తే సరిపోతుందని పేర్కొన్నారు. పోలీసు వ్యవస్థను స్వతంత్య్ర వ్యవస్థగా తీర్చిదిద్దితే సరిపోతుందని అన్నారు.

దేశానికి అప్రతిష్ట తేచ్చే బిల్లు: టిహెచ్ చౌదరి

మత బిల్లు దేశానికి అప్రతిష్ట తేచ్చేదేనని రాష్ట్ర ప్రభుత్వ మాజీ సలహాదారు టి. హనుమాన్ చౌదరి చెప్పారు. జాతీయ సలహా మండలి సభ్యులు హిందూ సంస్కృతిని తెగనాడటమే పనిగా పెట్టుకుని ఈ ముసాయిదాను రూపొందించారని అన్నారు. లక్షల కోట్ల రూపాయిల నిధులను సమీకరించి మత మార్పిడులకు పాల్పడుతున్నారని, ఎన్‌ఎసి నవీన దుష్ట చతుష్టయంగా తయారైందని ఎద్దేవా చేశారు. ఏ మత ఘర్షణ జరిగినా దానికి కారకులు హిందువులే అని ఈ చట్టం చెబుతుందని అన్నారు. రాజ్యాంగం కల్పించిన హక్కులను కాలరాస్తూ ఈ బిల్లులో నిబంధనలు ఉన్నాయని తెలిపారు.

Memorandum to His Excellency, the Governor of Andhra Pradesh.

Sarvasri Dr T.H.Chowdary of Pragna Bharathi, Js. S.Parvatha Rao, Gen ARK Reddy, Maj.Gen. A.B.Gorthi, former Directors General of Police Sri K. Aravinda Rao, Sri Roddam Prabhakara Rao and Prof. D. Manohara Rao, formerly of Osmania University met with His Excellency the Governor of Andhra Pradesh, Sri ESL.Narasimhan at 1600 Hrs. on Thursday, 10-11-11 at the Raj Bhawan and submitted a Memorandum urging upon him to forward the Memorandum to the Prime Minister and the President of India.

2. The Memorandum says inter alia, that the above Bill is subversive of the federal nature of the Indian state in that even as the maintenance of law & order is the primary responsibility of the State, a Commission constituted under the above Bill comprising of five members of whom the Chairman, Vice Chairman and Secretary have to be from the minority communities could recommend the imposition of President’s rule by dismissing the State government of the state in which a communal riot takes place and is not immediately controlled. It bypasses the Governor of the state who recommends the imposition of President’s rule. The Bill presumes that the majority community, that is, Hindus are ever intent upon creating communal riots to eliminate the minorities and therefore every communal riot is always started only by Hindus.

[This flies in the face of the facts to the contrary. In her well researched book, “Politics of Communalism”, Zenab Banu, a Muslim scholar, had presented an analysis of 74 communal riots between 1953 and 1977. She came to the conclusion that nearly 75% of these communal riots were started by Muslims).

Another researcher Sri Ram Kumar Ohri, IPS (Retd) found that in the first four months of the calendar year 2006, there were six (6) communal riots, all on Fridays; 3-02-06 Dhar (MP; 10-02-2006 Leh (J&K);17-02-2006 Muzafarnagar (UP); 24-02-2006, Karwan locality of Hyderabad (A.P); 03-03-2006, Lucknow (UP); 10-030-2006 Bengaluru and 24-04-2006, Thane (MH)].

3. According to the Bill any person of a minority community can lodge an FIR at the nearest Police Station saying that so and so of the majority community made such and such a speech or spoke or sang so and so thing which offends the sentiments of the minority and is likely to lead to rioting. He need not give his name or address . The Police Station is obligated to register the complaint and arrest the person accused. It has to further periodically report to the complainant about the progress of prosecuting the offender.

4. Rioting between two minority communities namely Christians & Muslims is not a communal riot. Rioting between say Kamma/ Reddy/ Kapus is not a communal riot. Only if either Muslims or Christians are involved as one group it is a communal riot. If Sunnis & Shias fight with one another, it is not a communal riot. It is obvious that the Bill is aimed at silencing Hindus and make them submit to the minorities, especially when religious conversions are objected to or resisted by Hindus .

5. This Bill slanders and calumniates the majority community, that is Hindus. The Memorialists requested His Excellency the Governor to convey to the President and Prime Minister their apprehensions and their request that this Bill should not be proceeded with. They have also pointed out that the Bill was drafted by the National Advisory Council which constituted another Advisory group of over 20 people half of whom are from the minorities and the rest are known Hindu- baiters.

Sub: – Appeal to ensure withdrawal of NAC-drafted Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Bill 2011.




Deeply concerned with NAC having come up with a draft bill seductively titled ‘Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Bill 2011’, we are approaching you to kindly use your good offices to ensure that this bill is not proceeded with to be enacted as law.

1. From times immemorial, the civilization and culture of this country has always laid enormous emphasis on principles like “Vasudaiva Kutumbam” (Whole world is one family), “Sarve bhavantu sukhinaha” (Let all be happy), “Ekam sat, vipra bahudha vadanti” (Truth is one, scholars interpret in different ways) etc. These principles dinned into generations of Bharatiyas over several millennia have taught us respect for plurality, for differences in belief, worship and living known as Sanatan Dharma, enriched by great souls like Buddha, Sankara, Vivekananda and Mohandas Karamchand Gandhi, have made Hindus as individuals an d groups cherish Ahimsa, tolerance, harmony and peace amidst variety. Suppression of non-believers, oppression of dissenters, persecution of blasphemers, fatwas to kill, inquisitions are not the culture of Hindus . Murderous sectarian wars, prohibition of peaceful preaching of dissent or banning of non-disruptive propagation of different faiths are repulsive to Hindus . Therefore Hindus do not, by their very dharma, preach, start or sustain communal violence, riot and killing of “others’. They sing Eswar, Allah (yahvew) tere naam, affirming their belief in the on-ness of God in His many splendorous names, forms and attributes.

2. There is more to the bill than meets the eye from its title and the real objective of the bill is not what it c
laims to be. In the guise of protecting minorities, it assumes that the majority community i.e Hindus is always the initiator and perpetrator of riots and violence, anytime, anywhere they may happen in the country.

The unwarranted assumption that the majority starts communal riots, subverts the secular foundations of India. The bill seeks to make criminal jurisprudence partisan and blatantly violates the principle of equality before law.

3. Inter-religious, and caste and communal and inter-linguistic amity and harmony should be carefully and consistently and ceaselessly promoted. Prejudicially presuming that the majority Hindu community always initiates anti-Muslim/Christian riots and therefore bringing a bill which legalizes this grotesque presumption is wrong; it will sow seeds of discord and intolerance between the presumed –guilty Hindu community and he assumed-innocent others. Trying to bring into force an utterly biased law, which confines its protective mechanism to persons and groups hailing from certain communities alone and distinguishes citizens in the eyes of law on communal and caste lines will only vitiate the atmosphere and sow seeds of suspicion and disharmony.

4. What is needed is that all communities in all regions of the country – whether they constitute a majority or a minority – are equally enthused and galvanized to pursue the larger national goal of unity in diversity. Strangely, far from promoting harmony, the NAC draft has the potential to wreck the prevailing amity among various religious groups and promote divisiveness. By making laws that are partisan and favour one community as against the other, the government would be doing a signal disservice to the idea of unity itself.

5. According to the provisions of the bill, whether a group is minority or majority would be looked at from state level. As you are well aware, a community which is a minority community in a State can be majority community at a local level. The highest number of religious riots in Andhra Pradesh have always started in the Old City of Hyderabad wherein a community which is a minority at state level is the majority community at local level there. But the protective mechanism under the proposed bill would be confined to that local majority community alone leaving the local minority community to a miserable fate.

6. That the bill is ill conceived and is indeed against Hindus only is evident from a few following examples:
  • Sectarian riots between Shias and Sunnis are not communal riots.
  • Riots between Christians and Muslims are not riots
  • Riots between Kammas and Kapus for eg. in Andhra Pradesh are not riots
  • The law is not to apply in J&K where Muslims are the majority
  • Singing vandemataram can be taken as offending Moslem sentiments and an FIR can be filed even anonymously by a Moslem and the person singing & his organization can be prosecuted. This is worse than the Blasphemy Law in Pakistan.
7. The draft bill creates an extra constitutional body comprising of a majority of “minorities” which can recommend to the President, imposition of Presidents” rule on the charge that the state government has failed to prevent and control communal riots.

8. Besides the obviously anti-Hindu nature, the draft bill affects (i) the status of state governments, whose concern is law and order and (ii) powers of Governors who can make recommendations for Presidents rule.

9. Here are some fine points to illustrate other defects, not taken cognizance by the Bill.
  • Experience shows that even ordinary laws are drastically misused in our country. Ex. Faction village – all members of rival faction are implicated in cases. In these cases the police have discretion to investigate freely, but in special acts the freedom is restricted and police are forced to take action.
  • Ill feelings between two persons are now leading to foisting of false cases under SC-ST Act against one another. Similar misuse can be there in a more frightening manner.
  • In case of misuse of SC-ST Act or Anti-Dowry Act only a person or a family is affected, but in this case the whole of society is affected. The majority population in a village has to live in constant fear of false cases.
  • There can be a planned and systematic misuse of the act as per a strategy and it can be centrally directed by group leaders. The same group leaders will be a pressure group on the government or administration to take action against innocent in foisted cases.
  • The definition of ‘victim’ and ‘harm’ is dangerous. There is no measure of mental or psychological harm. Sec. 3 (j). Anyone can complain that his feelings are hurt.
  • Sec 3(f) can be misused by anyone on the ground that his fundamental right to propagate his religion (and thus conversion) is violated even if the village or community elders object to such an act. There can be wholesale cases on the village elders.
  • Sec.8 talks about ‘hate propaganda’, the definition of which can result in action against any one preventing active hate and ridiculing propaganda by the other group on the ‘majority’ group. This is a reality which is seen every day in villages.
  • Any act should be designed to integrate the society but not divide the society. The present Bill may be well intentioned but ill conceived. It has not taken into account the amount of misuse which can take place and how police will be nose-led by pressure groups.
  • The Bill is also ill conceived because it has taken into consideration the majority and minority situation in India. It has totally forgotten that religion is a globalised issue now and that there are global strategies to devour smaller religions. The fund flow from outside India seems to have been totally lost sight of by the framers of this bill. Samuel Huntington’s studies have to be kept in mind on this issue.
10. The bill is drafted by the extra-constitutional National Advisory Council which in turn was advised by a large number of Muslims and Christians and known habitual Hindu-baiting, leftist nominal Hindus. This bill is a blot on federalism and secularism, to which India is constitutionally wedded. Justice demands that this bill be withdrawn forthwith.

11. We earnestly request you to kindly impress upon the concerned authorities to withdraw this shockingly biased and dangerously draconian legislation.

A Bill that damns the majority

The draft Prevention of Communal Violence Bill appears to be the handiwork of those social entrepreneurs who have learnt from the Gujarat experience of how to fix senior leaders even when they are not liable for an offence.


A draft of a proposed legislation titled "Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Bill, 2011" has been put in public domain. The draft Bill ostensibly appears to be a part of an endeavour to prevent and punish communal violence in the country. Though that may be the ostensible object of the proposed law its real object is to the contrary. It is a Bill which if it is ever
enacted as a law will intrude into the domain of the State, damage the federal polity of India, and create an imbalance in the inter- community relationship of this country.


What does the Bill in effect state

The most vital definition of the Bill is of the expression 'group'. A 'group' means a religious or linguistic minority and in a given State may include the Scheduled Castes and Scheduled Tribes. The Bill
creates a whole set of new offences in Chapter II. Clause 6 clarifies that the offences under this Bill are in addition to the offences under the SC & ST (Prevention of Atrocities) Act, 1989. Can a person
be punished twice for the same offence? Clause 7 prescribes that a person is said to commit sexual assault if he or she commits any of the sexual act against a person belonging to a 'group' by virtue of
that person's membership of a group. Clause 8 prescribes that 'hate propaganda' is an offence when a person by words oral or written or a visible representation causes hate against a 'group' or a person
belonging to a 'group'. Clause 9 creates an offence for communal and targeted violence. Any person who singly or jointly or acting under the influence of an association engages in unlawful activity directed against a 'group' is guilty of organised communal and targeted violence. Clause 10 provides for punishment of a person who expends or supplies money in the furtherance or support of an offence against a 'group'. The offence of torture is made out under clause 12 where a public servant inflicts pain or a suffering, mental or physical, on a person belonging to a 'group'. Clause 13 punishes a public servant for dereliction of duty in relation to offences mentioned in this Bill. Clause 14 punishes public servants who control the armed forces or security forces and fails to exercise control over people in his
command in order to discharge their duty effectively. Clause 15 expands the principle of vicarious liability. An offence is deemed to be committed by a senior person or office-bearer of an association
and he fails to exercise control over subordinates under his control or supervision. He is vicariously liable for an offence which is committed by some other person. Clause 16 renders orders of superiors
as no defence for an alleged offence committed under this section.


Any communal trouble during which offences are committed is a law and order problem. Dealing with the law and order is squarely within the domain of the State Governments. In the division of powers between the Centre and the States, the Union Government has no direct authority to deal with the law and order issues; nor is it directly empowered to deal with them nor it can legislate on the subject. The
Union Government's jurisdiction restricts itself to issue advisories, directions and eventually forming an opinion under Article 356 that the governance of the State can be carried on in accordance with the
Constitution or not. If the proposed Bill becomes a law, then effectively it is the Union Government which would have usurped the jurisdiction of the States and legislated on a subject squarely
within the domain of the States.


India has been gradually moving towards a more amicable inter- community relationship. Even when minor communal or caste disturbances occur, there is a national mood of revulsion against them. The Governments, media, the courts among other institutions rise to perform their duty. The perpetrators of communal trouble should certainly be punished. This draft Bill however proceeds on a presumption that communal trouble is created only by members of the majority community and never by members of the minority community. Thus, offences committed by members of the majority community against
members of the minority community are punishable. Identical offences committed by minority groups against the majority are not deemed to be offences at all. Thus a sexual assault is punishable under this
Bill only if committed against a person belonging to a minority 'group'. A member of a majority community in a State does not fall within the purview of a 'group'. 'Hate propaganda' is an offence
against the minority community and not otherwise. Organised and targeted violence, hate propaganda, financial help to such persons who commit an offence, torture or dereliction of duty by public
servants are all offences only if committed against a member of the minority community and not otherwise. No member of the majority community can ever be a victim. This draft law thus proceeds on an assumption which re-defines the offences in a highly discriminatory manner. No member of the minority community is to be punished under this Act for having committed the offence against the majority community. It is only a member of the majority community who is prone to commit such offences and therefore the legislative intent of this law is that since only majority community members commit these offences, culpability and punishment should only be confined to them. If implemented in a manner as provided by this Bill, it opens up a huge scope for abuse. It can incentivise members of some communities to commit such offences encouraged by the fact that they would never be charged under the Act. Terrorist groups may no longer indulge in terrorist violence. They will be incentivised to create communal riots due to a statutory assumption that members of a jihadi group will not be punished under this law. The law makes only members of the majority community culpable. Why should the law discriminate on the basis of religion or caste? An offence is an offence irrespective
of origin of the offender. Here is a proposed law being legislated in the 21st century where caste and religion of an offender wipe out his culpability.



Who will ensure implementation of this Act?


The Bill provides for a seven-member national authority for communal harmony, justice and reparations. Of these seven members at least four of them, including the Chairman and Vice-Chairman, shall only belong to a 'group', that is, the minority community. A similar body is intended to be created in the States. Membership of this body thus shall be on religious and caste grounds. The offenders under this law are only the members of the majority community. The enforcement of the Act will be done by a body where statutorily the members of the majority community will be in a minority. The Governments will have to make available police and other investigative agencies to this authority. This authority shall have the power to conduct investigations and enter buildings, conduct raids and searches to make inquiries into complaints and to initiate steps, record proceedings for prosecution and make its recommendations to the Governments. It shall have powers to deal with the armed forces. It has a power to send advisories to the Union and State Governments. Members of this authority shall be appointed in the case of Union Government by a collegium which shall comprise the Prime Minister,
the Home Minister and the Leader of Opposition in the House of People and a leader of each recognised political party. A similar provision is created in relation to the States. Thus, it is the Opposition at the Centre and the States which will have a majority say in the composition of the Authority.


What are the procedures to be followed ?


The procedures to be followed for investigations under this Act are extraordinary. No statement shall be recorded under section 161 of the CrPC. Victim statements shall be only under Section 164, that is,
before courts. The Government will have a power to intercept and block messages and telecommunications under this law. Under clause 74 of the Bill if an offence of hate propaganda is alleged against a person, a presumption of guilt shall exist unless the offender proves to the contrary. An allegation thus is equivalent to proof. Public servants under this Bill under clause 67 are liable to be proceeded against without any sanction from the State. The Special Public prosecutor to conduct proceedings under this Act shall not act in aid of truth but 'in the interest of the victim'. The name and identity of the victim complainant will not be disclosed. Progress of the case will be reported by the police to the victim complainant. The occurrence of organised communal and targeted violence under this Act shall amount to an internal disturbance in a State within the meaning of Article 355 entitling the Union Government to impose President's rule.


The drafting of this Bill appears to be the handiwork of those social entrepreneurs who have learnt from the Gujarat experience of how to fix senior leaders even when they are not liable for an offence.


Offences which are defined under the Bill have been deliberately left vague. Communal and targeted violence means violence which destroys the 'secular fabric of the nation'. There can be legitimate political differences as to what constitutes secularism. The phrase secularism can be construed differently by different persons. Which definition is the judge supposed to follow? Similarly, the creation of a hostile 'environment' may leave enough scope for a subjective decision as to what constitutes 'a hostile environment'.

The inevitable consequences of such a law would be that in the event of any communal trouble the majority community would be assumed to be guilty. There would be a presumption of guilt unless otherwise proved. Only members of the majority community shall be held culpable under this law. Members of the minority community shall never commit an offence of hate propaganda or communal violence. There is a virtual statutory declaration of innocence under this law for them. The statutory authority prescribed at the Central and State level would intrinsically suffer from an institutional bias because of its membership structure based on caste and community.


I have no doubt that once this law is implemented with the intention with which it is being drafted, it will create disharmony in the inter-community relations in India. It is a law fraught with dangerous consequences. It is bound to be misused. Perhaps, that appears to be the real purpose behind its drafting. It will encourage minority communalism. The law defies the basic principles of equality
and fairness. Social entrepreneurs in the National Advisory Council can be expected to draft such a dangerous and discriminatory law. One wonders how the political head of that body cleared this draft. When some persons carried on a campaign against POTA -- an anti-terrorist law -- the members of the UPA argued that even terrorists should be tried under normal laws. A far more draconian law is now being proposed.



The States will be watching hopelessly when the Centre goes ahead with this misadventure. Their power is being usurped. The search for communal harmony is through fairness -- not through reverse discrimination.

NAC’s Bill would land Dikshit in jail

Amid the annual madness over college admissions, Delhi is witnessing a sideshow in St Stephen's College, which its Principal has described as a "national treasure". It seems that Sandeep Dikshit, a Delhi MP and son of Chief Minister Sheila Dikshit, was dropped as the alumni representative on the college's governing body. The college authorities say that Dikshit hadn't attended a single meeting since 2009 and Dikshit has retorted that St Stephen's has lost the plot and functions like a "communal institution." In reply, Principal Valson Thampu has charged Dikshit of failing to distinguish between communalism and "minority rights."

Despite the headline-grabbing potential of anything to do with St Stephen's, this controversy is somewhat stale, and unless someone says something rash, is certain to peter out in the coming week. However, my reason for invoking this minor skirmish is different.
If the Communal Violence Bill (CVB) as drafted by the National Advisory Council is passed by Parliament, it is entirely possible that the Congress MP for East Delhi could well be confronted with a non-bailable warrant on the charge of creating a "hostile" and "offensive environment" against a minority institution [clause 3 (f) (5)]. A member of a minority group could walk up to any Police Station and submit that Dikshit's expression of disgust with St Stephen's had contributed to his "mental" and "psychological" harm [clause 3 (j)]. He would claim that Dishit's outburst "could reasonably be construed to demonstrate an intention to promote or incite hatred" against the Christian minority [clause 8]. Since the proposed legislation stipulates that "Every Police Officer shall take action, to the best of his or her ability, to prevent the commission of all offences under this Act" [clause 18 (2)], the relevant thana will have to register a case under the new legislation.

Nor can the politician in Dikshit brush off the case as yet another occupational irritant whose handling is left to a lawyer and forgotten. The CVB is explicit that "unless otherwise specified, all offences under this Act, shall be cognizable and non-bailable" [clause 58].
More insidiously, the proposed legislation has an intriguing clause: "Where any question arises whether an offence committed against a member of a group was committed against him or her by virtue of his or her membership of a group , it shall be so inferred that it was so directed from the nature and circumstances of the act" [clause 73]. In plain English, this means that there is a presumption of guilt of the accused. As far as the CVB is concerned, the principle of innocent until proven guilty has been turned on its head.

Cooling his heels in custody, the MP may wish to send someone to impress upon the complainant that he meant no harm to the "secular fabric" of the country. Unfortunately for him, the CVB is categorical that the "National Authority shall take appropriate action to protect the identity of the victim or informant at all times" [clause 40]. In short, the man charged with spreading communal hate won't even know which lunatic has made the complaint against him, and for what collateral reason.

In case, the Police Officer decides that the case against Dikshit is frivolous and completely spurious, that will not be the end of the story. The anonymous informant who has to be constantly updated on the progress of the inquiries [clause 69 (1)] will have the automatic right to appeal to a seven-member National Authority [clause 70 (1)].

The National Authority appointed by the Centre is not made up of seven sober and dispassionate judges. Of the seven, four must be members of a minority group or SC/ST and four must be women [clause 21(3)]. Apart from a knowledge of law, they must "have a record of promoting communal harmony" and shouldn't have been a member of a political party in the year preceding their appointment [clause 23 (1)]. Additionally, they shouldn't "have exhibited bias against any group, by acts or in writing or otherwise [clause 23 (2)]. It is unlikely such an authority will be unbiased.

For India, such a National Authority, blessed with draconian powers, including the right to enter properties, carry out searches [clause 33 (4)] and even control media content [clause 8 and 67(1)] may remind people of the infamous Rowlatt Act. But there is an added twist: this is the first time a statutory and quasi-judicial authority will be appointed on the basis of a communal quota. And this body will also monitor and review transfers and postings of the civil administration in districts that have a record of communal tension or where communal disturbances could flare up [clause 32(2)]. India will thus make its debut in coupling activist jurisprudence with communal jurisprudence. With a State Authority mirroring the National Authority and replenished by Human Rights Defender for Justice and Reparations' in each district [clause 56 (1)] it will not be jobs for all the activists and their friends, relatives and lovers.

India will witness a parallel government committed to the principle that some Indians are more equal than others. It will open the floodgates for settling private scores and political vendetta. The dangers of outsourcing law-making to the self-professed army of the virtuous couldn't have been better illustrated.

Sandeep Dikshit is lucky he said what he did in the twilight days of sanity.

The gross violence that unfolded on the night of June 4/5th at Ramlila Maidan in New Delhi speaks volumes of the general intent of the UPA government where Hindus are concerned. Obviously, Hindus do not have the right to protest against corruption and black money, or perhaps against anything. They are only permitted to do yoga!

If one were to scroll back archive pages of recent months, one would easily see that Baba Ramdev had initiated a campaign against corruption nationwide, well before Anna Hazare sprang a surprise on the nation along with his colleagues with dubious reputations. Therefore, one actually wouldn’t get any prize for guessing what went behind the façade of the UPA government to unleash such aggression against unarmed and non-violent Hindus, including women and children who were sleeping and dreaming of a better India. The difference here was that Anna Hazare had a pseudo-secularist cloud around him that appealed to the dynasty, while Baba Ramdev was a Hindu who threatened the dynasty’s loot!

Baba Ramdev is not an unknown Indian. He is a dynamic guru who wants to instil something of the spiritual essence of ancient India that has been lost to ordinary Indians. He has lakhs of followers throughout the country who respect him and have benefitted through him and consider him a genuine leader worthy to be considered a guru. However our central government under dynasty rule, which in fact is a continuation of colonial rule, have scant respect for such a figure.

Doesn’t the UPA worry about the Hindu votes that would be lost by this event? The ruling party’s actions show this is the last thing on its mind. For the UPA under Sonia Gandhi, Hindus, even the likes of Baba Ramdev and followers, seem to be the least of their worries. They think they can buy the Hindus, like they always did. Is it really so?

Not exactly, if we bring Narendra Modi into the picture. He is the one leader who can unite not only Hindus, but Muslims as well, as we have seen in Gujarat. And once he is on a roll all over India, as in Gujarat, they know they cannot stop the juggernaut. Modi is today perceived by the anti-Hindu brigade across the nation and the world as their nemesis. With the human rights industry under its armpit, the UPA has shown what it can do to a poor sadhu and his innocent followers. They can swat a hundred Baba Ramdevs with iron fists. But they can’t mess with Modi. Of course, they would if they could, but they can’t yet. And, take it from me, they are biding their time.

In the chronicles of Indian history of the present time written in future, the shadow of Narendra Modi would loom large across the nation, not only for the exemplary trend he set in polity and political ethics in 21st century India. For his enemies, Narendra Modi is an icon of the Hindus who has to be destroyed first, if Hindu civilisation is to be totally destroyed. Modi is an exception among Hindus and stands out for being politically successful and also in repelling from time to time the full-court press employed by his powerful enemies, who have been terribly vanquished each time they tried, but have never taken it lightly or gracefully.

It is a strange syllogism, for the BJP is not all Modi and Modi is not all BJP, but the BJP sans Modi is no BJP, if BJP were to be an opposition. Without Modi’s track record, the BJP is actually nothing but an also-ran. If one didn’t know better, the top leadership could be accused of mimicking the Congress party and bowing down to the dynasty. There is no BJP leader other than Narendra Modi who has proved himself or herself either as a worthy ruler, or as an opposition leader and created a curriculum vitae he could show around proudly. What stands between the total subjugation of Hindus and the anti-Hindu brigade under dynasty rule is Narendra Modi. The enemies know it and so should we all!

Enter The National Advisory Council

After scheming for years, Modi’s enemies, comprising his political opponents, chiefly the Congress and the Marxists, and the mighty anti-Hindu brigade from across the world (including the influential US Commission on International Religious Freedom), have been relentlessly drawing and re-drawing battlelines against Modi, which as I pointed out earlier, are ultimately aimed at the Hindus. When it became obvious that twisting the due processes of Indian law was not working for the annihilation of Modi, special agents were hand-picked and congregated in the so-called National Advisory Council with Sonia Gandhi at the helm.

The sole brief given to the working committee seems to concern only with clipping Hindu aspirations and hence, the subjugation of Modi. It would seem the only advice the current government considers worth having is how to thrash the Hindus best. The machinations of the advisory council under the Grey Eminence is slightly reminiscent of the Catholic power peddling in medieval France that ultimately led to a revolution.

Given the money and political backing of the enemies, it was a foregone conclusion that it was only a matter of time before the next serious charge against Modi and the Hindus appeared on the horizon. The draft of a bill they cooked up after spending vast public money and probably thousands of man-hours and ironically named “The Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Bill, 2011” is the latest in the series. But the whole enterprise smacks of hate and virulent animosity towards the majority community and envy of their success. Visit http://nac.nic.in/communal/com_bill.htm to read the draft, if you must. Not recommended, however.

Only once the reader realises that all that have been said in the draft exempt the Hindus from its purview, does the real motives of the Advisory Council appear through the dreary haze. According to this bill, victim can be anybody but a Hindu. For the purpose of splitting Hindu votes in parliament, they have also de-Hinduised the so-called scheduled castes and scheduled tribes. The bill aims solely to silence and stifle a government such as Modi’s and to take away the democratic rights of a majority community such as the Hindus. With this bill in force, the Abrahamists (synonym for pseudo-secularists) will figuratively be at the peak of Mount Everest, Narendra Modi’s government will be fired automatically by remote control, and the Hindu majority disempowered absolutely and completely.

For those who don’t want to waste their time reading silly literature in the bill draft, I am quoting Clause 8 of the said bill: “Hate propaganda.– Notwithstanding anything contained in any other law for the time being in force, whoever publishes, communicates or disseminates by words, either spoken or written, or by signs or by visible representation or otherwise acts inciting hatred causing clear and present danger of violence against a group or persons belonging to that group, in general or specifically, or disseminates or broadcasts any information, or publishes or displays any advertisement or notice, that could reasonably be construed to demonstrate an intention to promote or incite hatred or expose or is likely to expose the group or persons belonging to that group to such hatred, is said to be guilty of hate propaganda.”

The article 153A of the Indian Penal Code, 1860, covers this aspect but is deficient for the purpose of the Advisory Council, because it also includes Hindus in its purview. This new bill however is absolutely necessary for the anti-Hindu brigade, so that the right to justice of the Hindu majority is denied, because the “group” specified in this bill is exclusively confined to any group other than Hindu, which excludes all those who have not been converted into Abrahamists or bracketed as scheduled castes or scheduled tribes. It means if the anti-Hindu brigade were to have their way in India, Hindus would be punished for every riot in India, no matter who instigated it.

Who actually engineers riots in India?

According to Ms. Zenab Banu’s “POLITICS OF COMMUNALISM: a politico-historical analysis of communal riots in post-independence India with special reference to the Gujarat and Rajasthan riots” (1989), there had been 74 communal riots between 1953 and 1977, of which 75% were instigated by Muslims. For those who are apologetic about the demolition of the Babri Masjid and blame the act for Muslim aggression, these figures will elucidate and make clear who were in reality responsible for communal riots ever since they were born – the Abrahamists!

If the proposed bill were to include Hindus in its purview, the original hate literature and propaganda which have been instigating and inciting human beings to kill each other for scores of centuries, such as the Bible and the Koran, would be banned and the comically attired perpetrators put behind bars. On the other hand, by excluding Hindus from the purview of the proposed bill, the pseudo-secularists in the Advisory Council are striving to chop off the defending Hindu arms, thus blaming the victims for all the communal riots to come!

This mockery of a bill is the main component of a conspiracy to thwart the “Narendra Modi phenomenon” that would soon engulf the whole of India like a storm, unless the Abrahamists do something soon and something effective to get the conspiracy smoothly implemented. The rational fear of Rahul Gandhi for the Hindus is reflected in a Wikileak report, according to which he confessed to an American diplomat his angst for them, whom he termed as “extremists”.

The dynasty of Sonia and Rahul Gandhi is holding on to power not because they are genuinely democratic rulers (as Ramlila Ground on June 4 would testify) or that they sincerely want to rule for the sake of a nation, but because the loss of power would bring about their certain ruin and destruction, like Gaddafi, like Mubarak, a fate that can only be postponed but not avoided, just like death. When Sonia and Rahul refer to India that is Bharat, they are not talking about the physical land or its civilisation or the billion odd people who inhabit this land, but their loot that has been stashed away in Europe. Moreover there is tacit support (and I suspect even pressure) from the Christian West for the transformed Catholic dynasty to rule Hindu India until the imaginary doomsday.

Seen from another angle, the conspiracy has entered a crucial stage, when several Hindu activists are already languishing in jails for years now on fabricated charges that have never been proved or would ever be resolved or even come to court, at least as long as the UPA is in power. The recent attempts to implicate people belonging to nationalist organisations like the RSS in terror plots should also be seen as part of a bigger game involving those who want to perpetuate the dynasty rule and save private loot deposited illegally in overseas banks.

Most of the names in the advisory council, particularly in the working committee and the bill drafting committee, would bring a sense of déjà vu to those who followed the aftermath of the 2002 Gujarat riots, when human vultures flew hither and thither to exploit the bloody tragedy. Scheming behind closed doors of the obnoxious council are the notorious battle-scarred front-line veterans in the war against Modi and the Hindus – Teesta Testalvad, Harsh Mander, Syed Shahabuddin, John Dayal and co. The dynasty has also engaged professional claques led by the inimitable duo Digvijay Singh and Kapil Sibal, who are adept at tackling poor unarmed folks roughly and faithfully cook rice for the thief (old Malayalam saying).

Kill the mocking bill before it is born and a great impediment placed before Hindus by the enemy would be removed and it would mark a new beginning, sounding the death knells for dynasty rule, corruption, adharma, all in one sweep.
